​Winfield ​IL Fence Code

A permit is required for the construction, installation or erection of all fences except landscape and garden fences. Permit fees are found in section 9-1-4 of this title. (Ord. 2006-9-41, 9-7-2006)
9-5-3: FENCE REQUIREMENTS:
   A.   All Fences: All fences, in all zoning districts, shall be erected so that the finished side of the fence shall face outward from the property on which it is erected.
   B.   Business, Town Center, Industrial And Public Zoning Districts: A minimum six foot (6') high fence with a closed fabric design or compact hedge shall be erected along the lot line of lots in districts zoned Business, Town Center, Industrial or Public where such lot lines abut a Residence District so as to provide effective screening. The owner of such a lot shall be responsible for the erection and maintenance of the required fence or hedge.
   C.   Multi-Family Zoning Districts:
      1.   A minimum six foot (6') high fence with a closed fabric design or compact hedge shall be erected along the lot line of improved lots in districts zoned Multi-Family where such lot lines abut Single-Family Residence Districts. The owner of such a lot shall be responsible for the erection and maintenance of the required fence or hedge.
      2.   For the purpose of this subsection, multi-family is as defined in the Winfield Zoning Ordinance.
      3.   This provision does not apply to lot lines within a planned unit development since the Winfield Zoning Ordinance contains screening requirements applicable to such development.
   D.   Swimming Pools: Fences shall be erected around swimming pools as required in the Winfield Building Code, chapter 1 of this title. (Ord. 2018-12-39, 12-20-2018)
9-5-3-1: RESIDENTIAL DISTRICTS:
   A.   Height Limitations: No fence shall be erected in excess of six feet (6') along interior or rear lot lines; provided, that the height limitations contained herein shall not apply to shrubs or hedges on interior lot lines or rear lot lines except as required by section 9-5-3 of this chapter, and shall not apply to property owned by tax levying districts, and all fences abutting regulation size tennis courts shall be exempt from the height limitations of this chapter.
   B.   Location: Except as follows, all permitted fences must be constructed within one foot (1') of the fence owner's interior or rear lot lines, and all such fences shall be permanent and not temporary structures. Exceptions are as follows:
      1.   Patio privacy fences not to exceed six feet (6') in height within the rear and side building lines.
      2.   A dog enclosure or run not to exceed six feet (6') in height, or enclose an area greater than twenty percent (20%) of the rear yard may be constructed in the rear yard, providing it is set back five feet (5') from all property lines.
      3.   Garden fence enclosing a garden in a rear or side yard, not to exceed four feet (4').
   C.   Permitted Fences In Residential Districts In Subdivisions On Major Arterial Highways: Notwithstanding the provisions of subsection 9-5-4E of this chapter, to allow for some degree of uniformity in perimeter fencing, in connection with the approval of subdivisions that have two (2) or more lots that adjoin major arterial highways as defined herein, the President and Board of Trustees may allow a corner side yard fence to be located closer to the abutting major arterial highway subject to the following limitations:
      1.   At least fifty percent (50%) of the lots improved with single-family residences and located within the corporate limits and within three thousand feet (3,000') of and on the same side of the major arterial highway as the subdivision, have fences (other than landscape and decorative fences) in the corner side or rear yards abutting the major arterial highway.
      2.   The developer of the subdivision desires to provide uniform screening from the traffic and noise caused by that major arterial highway and one or more of the lots in the subdivision are platted so that the rear lot line, as defined in the Zoning Ordinance 1 , abuts the major arterial highway and therefore the desired screening is allowed for that lot.
      3.   The corner side yard fence is located within three feet (3') of the lot line.
      4.   The corner side yard fence is not located in the vision triangle formed by drawing a straight line along the property line abutting each intersecting street a distance of twenty five feet (25') commencing at the point where the corner side yard lot line and the front yard lot line meet, and then connecting the termination points of each of those lines to enclose a triangle.
      5.   The corner side yard fence does not extend into the front yard. (Ord. 91-10-4, 10-1991)

9-5-4: PROHIBITED FENCES:
The following fences are hereby prohibited:
   A.   Wire And Electric Fences:
      1.   Barbed wire, chicken wire (unless used to enclose a rear or side yard garden), hog wire, rope, cable and electrically charged wire; except, that barbed wire may be used on top of permitted fences in Industrial Districts and on fences enclosing property owned by a tax levying district.
      2.   Chain-link fences with barbed ends up.
   B.   Snow Fences: Snow fences, except those erected for the sole purpose of controlling drifting snow between November 1 and March 31, installed only on that portion of a lot which faces or abuts a road, street or highway, and which are in place only between November 1 and March 31.
   C.   Fences Blocking Surface Water Drainage: A fence which is so constructed as to prevent natural water drainage and/or water runoff.
   D.   Gates Or Fences Across Driveways: No gate or fence is permitted across a driveway within the front or side yard abutting a street in a Residence District.
   E.   Fences In Front Yards: Any fence, except a required fence, a decorative or landscape fence as set forth in sections 9-5-1 and 9-5-3 of this chapter, in a front yard, if the fence would be closer to any street or roadway than the front building lines established by the building or residence as located on the lot (see figure A of this section).
   F.   Corner Lot Fences: Any fence on a corner lot which extends closer to the adjoining street than the front or side line of the existing structure (see figure A of this section) except for decorative and landscape fences as permitted in section 9-5-3 of this chapter. Notwithstanding the foregoing, the Building Commissioner, without a public hearing, on application by the property owner, is authorized to issue variance to allow the following:
      1.   With respect to corner lots in Business Districts (including the Town Center), a fence on a corner lot to extend closer to the adjoining street than the front or side line of the existing structure principal building, if screening from an adjoining use is desirable but not otherwise required by this chapter, on the condition that the fence extend no closer to the adjoining street than the line of an existing structure on an adjoining lot, and that the fence not create an additional vision obstruction for traffic or pedestrians.
      2.   With respect to corner lots in all Residential Districts, if an existing corner side yard is wider by more than five feet (5') than the corner side yard width required by the regulations of the Residential Zoning District in which it is located and the location of one or more mature trees makes it impossible to place a fence as close to the street abutting the corner side yard as this chapter would otherwise allow, then a corner side yard fence can be located closer to the abutting street right-of-way subject to the following limitations:
         a.   The fence must be at least one foot (1') from, but not within, said right-of-way.
         b.   No fence shall be located in the vision triangle formed by drawing a straight line along the property line abutting each intersecting street a distance of twenty five feet (25') commencing at the point where the corner side yard lot line and front yard lot line meet, and then connecting the termination points of each of those lines to enclose a triangle.
         c.   That part of the fence which is located in the corner side yard cannot exceed four feet (4') in height and must be open weave design so that the fence is at least fifty percent (50%) open.
